Terms of Service / General Terms and Conditions (GTC) – Wine Berlin

OVERVIEW

Welcome to Wine Berlin! The terms “we”, “us” and “our” refer to Wine Berlin (Oliver Leutnecker, sole proprietorship). Wine Berlin operates this online shop and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Wine Berlin uses Shopify to provide you with the Services.

These General Terms and Conditions (“GTC” or “Terms”) describe your rights and obligations when using our Services.

Please read these Terms carefully, as they contain important information about your legal rights, in particular regarding orders, payment, delivery, warranty and liability.

By accessing, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree to these Terms or the Privacy Policy, you may not use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are of legal age (at least 18 years old) and that you consent to allowing any of your minor dependents to access the Services via devices owned or controlled by you.

To use our Services (including browsing, creating an account or purchasing products), you may be required to provide certain information, such as your email address and billing, payment and shipping details. You warrant that all information you provide is accurate, current and complete, and that you are authorized to provide such information.

You are solely responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You may not transfer, sell or license your account to any third party.

SECTION 2 – OUR PRODUCTS

We make every effort to describe and display our products as accurately as possible in our online shop. Please note, however, that colors and the appearance of wine labels and packaging may vary depending on screen, device and settings.

We do not guarantee that the appearance or sensory characteristics of the products purchased will exactly match your expectations; your statutory warranty rights remain unaffected.

All product descriptions and prices are subject to change at any time without notice. We reserve the right to discontinue products or limit quantities per person or per order at any time.

Sale of Alcohol:
Alcoholic products may only be sold and delivered to persons aged 18 or over. By placing an order, you confirm that you are at least 18 years old. We reserve the right to carry out an age verification (e.g. upon delivery).

SECTION 3 – ORDERS

By placing an order, you submit a binding offer to conclude a purchase contract. We may accept or reject orders at our discretion. A contract is only concluded once we expressly accept your order (e.g. by order confirmation) or dispatch the goods.

Please carefully review your order before submitting it. Once an order has been accepted, changes or cancellations may no longer be possible.

Returns or exchanges are governed exclusively by our Cancellation Policy.

You confirm that your orders are intended for private household use only and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

All prices are shown in euros and include statutory VAT, unless expressly stated otherwise. Shipping costs may apply and will be displayed during the checkout process.

Prices, discounts and promotions may change at any time without prior notice. The price applicable is the one displayed in the shop at the time of your order and confirmed in the order confirmation.

You agree to provide current, complete and accurate billing, payment and contact information for all purchases and to promptly update such information if it changes.

SECTION 5 – SHIPPING AND DELIVERY

We deliver exclusively within Germany.

Delivery is carried out by a shipping service provider of our choice. Estimated delivery times provided during checkout are non-binding guidelines.

We are not responsible for delays caused by shipping providers, unforeseen events or circumstances beyond our control. Your statutory rights, in particular in cases of delay, remain unaffected.

For consumers, the risk of accidental loss or deterioration of the goods passes only upon delivery to you or a person authorized by you to receive the goods.

Please inspect your order immediately upon receipt and contact us without delay if the goods are damaged or incorrect, so that we can review the matter and find a suitable solution.

SECTION 6 – INTELLECTUAL PROPERTY

All content of the Services, including but not limited to trademarks, logos, text, descriptions, images, graphics, layouts, video and audio content, and their selection and arrangement, is the property of Wine Berlin or its licensors and is protected by German and European copyright, trademark and other intellectual property laws.

You may use the Services solely for personal, non-commercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, publicly display or otherwise exploit any content, except as permitted by law (e.g. private use).

The names, logos, product and service names, designs and slogans of Wine Berlin are trademarks or protected identifiers of Wine Berlin or affiliated entities. Shopify trademarks belong to Shopify. All other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools and features that we do not monitor or control.

You use such tools at your own risk and discretion. Please review the terms and conditions of the respective third-party providers before using such tools.

New features or tools added to the Services in the future will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites or content. We assume no responsibility for the content, accuracy or functionality of such third-party sites.

Accessing third-party content or websites is at your own risk. Any contracts, purchases or legal relationships are formed exclusively between you and the respective third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Wine Berlin operates on the Shopify platform in order to provide the Services. However, all sales and purchases are concluded directly between you and Wine Berlin.

By using the Services, you acknowledge that Shopify is not responsible or liable for our products, content or contracts. Any claims arising from or in connection with purchases must be directed exclusively to Wine Berlin.

SECTION 10 – PRIVACY POLICY

All personal data collected through the Services is processed in accordance with our Privacy Policy [LINK].

As our Services are hosted via Shopify, Shopify also processes personal data as part of providing the platform. Further details can be found in our Privacy Policy and in Shopify’s Privacy Policy.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, ideas, suggestions or other content (“Feedback”), we may use such Feedback to operate, improve and promote our Services to the extent permitted by law, without any entitlement to compensation.

You confirm that you are authorized to submit such Feedback and that it does not infringe third-party rights. We reserve the right to refuse or remove Feedback that violates applicable law or these Terms.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our Services may contain typographical errors, inaccuracies or omissions (e.g. relating to product descriptions, pricing or availability). We reserve the right to correct such errors and update information at any time, where reasonable. Your statutory rights, especially regarding existing contracts, remain unaffected.

SECTION 13 – PROHIBITED USES

You may use the Services only in compliance with applicable law. In particular, you must not use the Services to:

  • distribute unlawful content

  • infringe third-party rights (e.g. copyrights, trademarks or personal rights)

  • transmit malware, viruses or other harmful code

  • impersonate another person

  • send unsolicited advertising (“spam”)

  • circumvent security features of the Services

We reserve the right to suspend or terminate your account and to take legal action in case of violations.

SECTION 14 – TERMINATION

We may terminate or restrict your access to the Services, in whole or in part, for good cause, in particular in case of violations of these Terms.

Any payment or performance obligations incurred prior to termination remain unaffected.

SECTION 15 – DISCLAIMER OF WARRANTIES

Information provided through the Services is for general informational purposes only. We do not guarantee that all content is always current, complete or error-free; your statutory warranty rights remain unaffected.

We owe only the contractually agreed quality of the products. Taste preferences are subjective and do not, in themselves, constitute a defect.

SECTION 16 – LIMITATION OF LIABILITY

We are liable without limitation:

  • in cases of intent or gross negligence

  • for injury to life, body or health

  • under the Product Liability Act

  • to the extent of any guarantee expressly assumed by us

In cases of slightly negligent breach of essential contractual obligations (obligations whose fulfillment is essential for the proper performance of the contract and on which you regularly rely), our liability is limited to foreseeable, contract-typical damage.

Any further liability for slight negligence is excluded.
Mandatory statutory liability provisions remain unaffected.

SECTION 17 – SEVERABILITY

If any provision of these Terms is or becomes wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in place of the invalid clause.

SECTION 18 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise any right under these Terms shall not constitute a waiver of such right.

These Terms and all policies referenced herein (in particular the Cancellation Policy and Privacy Policy) constitute the entire agreement between you and us regarding the use of the Services and supersede any prior agreements.

SECTION 19 – ASSIGNMENT

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations, in whole or in part, provided that your legitimate interests are not unreasonably affected.

SECTION 20 – GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer with habitual residence in another EU Member State, mandatory consumer protection provisions of that state remain unaffected.

You can review the current version of these Terms at any time on this page.

We reserve the right to amend these Terms for valid reasons (e.g. changes in law or expansion of the Services). We will inform you of material changes in accordance with legal requirements. Continued use of the Services after the changes take effect constitutes your acceptance of the updated Terms.
